my daughter saw a puppy locked in a hot car on a hot day at the mall when she arived.when she left about ahalf hour later, he was still in the car. worried he could die in there,she reached into a partially open window and unlocked the door using her finger.she took the puppy home to save it,leaving a written note signed by her to let the owners know the dog was safe and later got the dog to the police and saftly back to his owners. a week later she recieved a notice she was being charged with breaking into the car and taking the owner's property. how should this be handled?

The charge should be dismissed by the county prosecutor if it is handled correctly. You need to hire an attorney.

This is clearly not the kind of case the law had in mind when prohibiting taking property from a car. However, that is technically what happened. You should have an attorney involved in order to speak with the prosecutor and make sure he does the right thing. Call me if you would like to discuss it further at 877*688*3879.

How old is your daughter? If she is under 18, this will be heard at the Superior Court. If she is 18 or older it will likely be heard at the Municipal Court. Although she felt she was doing the correct thing, she really should have called the police and let them handle it. She is charged with a fairly serious crime, and should probalby be represented by a lawyer.
