ny resident arrested in nj

I was recently arrested in NJ on drug possession (small baggie or pot) and a pipe. I live in NY. Can any lawyer represent me? Do I need a NJ lawyer?

Yes a lawyer can represent you, and yes he needs to be licensed to practice law in New Jersey (or at least has to get special permission from the court system to handle your case in NJ if he is not licensed here - it is better to get a lawyer who is licensed in NJ). You need a lawyer admitted to practice in NJ. If you have an attorney in NY, he might be able to be admitted in NJ just for your NJ case. This is called an admission pro hac vice. Good luck.

If you want to hire a lawyer, you do need to hire one that is licensed in New Jersey. It sounds like the charges will be heard in municiapl court in the town where you were arrested. I commonly handle these matters if you wish to discuss further.

Yes, you need an attorney licensed in NJ, or you can go yourself and take your chances....not a recommended course of action for a lot of reasons (a lawyer ofter gets you a smaller penalty or gets a smaller offense), but sometimes I see Judges allow people to plead guilty to certain infractions without s lawyer.

Depending on the circumstances, this may carry a driver's license suspension, so I suggest talking to a lawyer before you do anything. What town in NJ are we talking about/ That also makes a huge difference in how things will be handled. Write back to [email protected] with any questions....
