Legal Question in Criminal Law in New Jersey
Obstruction of Justice charge for providing a false name?
My fiancee was driving while having a suspended license. While being pulled over for a headlight being out on the car, he gave a false name to the police in fear of being arrested. Months later we find out he has a charge of obstruction of justice and never had gotten a ticket or court date. ( ihad to bail him out of jail for this). Was that incident (giving a false name ) obstruction of justice? If not, we have no idea what the charge is about. And what are the penalties for this charge if pleading guilty?

Yes.......giving a false name is obstruction of justice. It is a 2C crime.

Giving the false name to the police officer is the reason your boyfriend got the charge for obstruction of justice. Depending upon how it was written by the officer, it is either a disorderly persons offense which could result in up to six months in jail and over $1,000 in fines if you just plead guilty or it is a fourth degree felony which could result in up to 18 months in jail and over $10,000 in fines if you just plead guilty. I am an attorney who has handled many cases similar to yours in various courts in New Jersey in the past. Please call me if you would like to discuss this in more detail. There is never any charge for simply talking to me about a case. Thank you.
