Official Misconduct

In NJ if a correctional officer is accused of official misconduct because of a sexual encounter with a prisoner, can the prisoner also be charged with a crime by the prosecutor's office?

I would need a lot more information before I can give you a definite answer to this question. In general though, if the only thing involved here is that the correctional officer had a sexual encounter with a prisoner, it would seem that based on solely those facts that only the correctional officer would be subject to any criminal charges.
