Ongoing Harrasment and Damage to Property
Since 2007, when my neighbor was found violating a Dept. of Health Oridnance and Zoning Ordinance, we have been having ongoing problems of children and guests trespassing, visitors damaging my front lawn, her kids playing baseball on my front lawn and damaging my sprinkler heads. We decided to build a fence between properties, did all the legal stuff with the City, got a Survey, her shed was encroaching on my property by 1.5 feet, sent her a very nice letter indicating our intentions and need for her to move the shed, which she did. Now we have our fence up-expensive Vinyl PVC, and her kids kick the fence on her side of our fence and throw balls- using the fence as a play wall. I sent her a letter indicating this and now she has Summoned me to Municipal Court in Vineland because I am harrassing her and threatening to take her to court if this does not stop. Should I counterclaim? I have the minimal of information all in writing, dates of her verbal assaults, etc. I work for a large Corporate Firm in Philly so I am quite organized. The Plea date is 8/14/.

The municipal courts have a mediation program designed to help people resolve neighborhood disputes. When you appear in court you should request that your case be referred to mediation.

According to the facts you provide you do have a potential counterclaim. Regardless you now must appear in Municipal Court to defend the allegations against you. You can go to the court and prepare the counter claim pro-se, however I would advise you have attorney assist you with the filing and appear on your behalf. You should file a counter complaint or complaints so long as they are well founded. You also need the services of an attorney.
