Overpaid pay check

What criminal actions could be takin if I cashed and spent an overpaid check from my employer.

you could be charged with theft. if one keeps property that one knows is lost/mislaid, or one knows or should know one does not have lawful reason to possess due to mistake of another, you may be charged with theft. the degree of the theft depends on the amount of money involved. over $500 but less than $75000 is a third degree. between $200 and $500 is a fourth degree and less than $200 is a disorderly persons offense.

Depending upon the amount of overpayment that you cashed and spent, you could be charged with anywhere from a disorderly persons theft charge to a first degeree theft charge, with penalties of fines and jail time ranging from a little to very much. Anyway you look at it, it is a theft charge and you could be facing criminal penalties. I am an attorney who has handled many cases similar to yours in various courts in New Jersey in the past.
