Passing a forged check

Is passing a forged check a criminal act, even if the check passer, claims he did not know the check, was a forgery

It is still a criminal offense. The lack of knowledge could act as a defense to the criminal charge, but does not automatically make it go away.

Claiming you did not know the check was forged is a defense which can be raised. The question is whether a jury will believe that someone negotiated a forged check from a third party, given the explanation of the circumstances of receiving and using the check. The person who passed the forged check has a problem requiring the assistance of an attorney.
