Legal Question in Criminal Law in New Jersey

Passport info

My brother was charged with credit card theft, forgery and other ralated charges i NJ about three years ago. He has completely disregarded these charges, moved to Florida and is living a good life. He thinks these charges no longer exist becuase he was never arrained. He wants to get a passport and I fear that if he does he will be arrested and sent back to NJ. Is there a statute of limitations on these charges and if he tries to travel outside the country via plane or by cruise will he be arrested? I'd like to help him put this behind him so please help me. Thank you.

If his name is checked at the airport and his name shows up showing a warrant for arrest he will be arrested on the spot.

He is facing a ton of problems and there is a good chance that he will be arrested at some point here. I suggest you contact an attorney ASAP!

You sound like a nice person, but I am always astounded at how the public does not understand the concept of the statute of limitations. The statute of limitations prevents the state from CHARGING you with a crime after a certain date. Like, you could not be arrested now for stealing gum at Wawa in 1985. The statute of limitations does NOT mean that if you are charged, you can just run away for ten years and the charges disappear. Can you imagine what the effect on society would be if that were the case? EVERYONE would just go on the lam if they were charged--why in the world would anyone ever respond to any charges? No, more than likely, your brother was convicted in absentia. He will require a NJ attorney to deal with these charges. I think getting a passport is the very least of his worries. More than likely, the first time he gets pulled over, the computer will show his name and he will be arrested and extradited. He should immediately retain an attorney before it gets worse.
