Legal Question in Criminal Law in New Jersey

Penalties?

My boyfriend tonight was pulled over because his inspection sticker was not valid-- however, the date posted on the sticker for him to pass inspection was not yet expired. The police then saw an open bottle of vodka in his backseat (but he had not been drinking), then searched him and found 10 Vicodin. His court is tomorrow morning at 10am, what are the expected charges/penalties? He is 18.

Re: Penalties?

There is the potential for jail time and loss of driving priveleges along with very high fines. However, based on what you write, your boyfriend may have an actual defense to this case and there is the possiblity of beating this charge. Please contact me to discuss this case in more detail. I never charge for simply talking to a person about their case. Thank you.

Re: Penalties?

I would expect that he os charged with having drugs while driving a car, a motor vehicle offense with a two year license suspension upon conviction, and possession of a controlled dangerous substance, a criminal offense which may be eventually reduced to a disorderly person offense. but which has another six month license suspension if found guilty or if he pleads guilty.

There are a number of possibilities.

Call me if you like. Nothing of consequence should happen in court tomorrow; he should not plead guilty without sitting with a lawyer who has the police reports.
