Penalties for NJS 2C:35-10A

There are a range of penalties for this offense, from dismissal to 20 years in prison, depending on the following factors:

1. the type of cds

2. the quantity of cds

3. the age of the offender

4. the criminal history of the offender.

In addition, the utltimate outcome depends on the strength of the State's case. If the drugs were found in a search which is suspect, the charges may either be dismissed, or the state may seek to take the risk that the charge will be dismissed by giving a better deal.

Bottomline, is you max. penalty can be up to 6 months in jail is this is a dis orderly persons offense. It all depends on the type of drugs and the weight. There are very high fines and probation as a possibility. You may qualify for a conditional discharge, which means you do probation if sucessful, the case will be dismissed against you.
