Legal Question in Criminal Law in New Jersey

perjury

I was a defendant in a harrassment case in municipal court. The case was just dismissed without prejudice. The key prosecutors wittness has been charged with perjury and making false statements. The total costs for my attorney plus extra fees exceeds 50,000. Can I sue this wittness to recoup any of my money? What if anything would be the penalty for perjury, would he have a criminal record?

You may have a cause of action for MALICIOUS PROSECUTION and/or ABUSE OF PROCESS. Legal fees are recoverable as long as you prevail. You need an attorney who can order the trial transcript, get more information and advise you if you can proceed with the above causes of action.
