The first failure to appear raises the possibility that there might be foul play, causing the case to be rescheduled and another effort to be made to give the plaintiff notice of the next hearing. If a plaintiff wants to drop a complaint it is better that the plaintiff appear in court and advise the judge of the desire to voluntarily dismiss the complaint.
