No, you can get out of it before sentencing. However, it may be difficult to do, it depends on your reason. You will probably need a new lawyer as your old lawyer may now become a witness for this proceeding. The way that guilty pleas are take is designed to give the case finality; retracting a guitly plea is difficult, but it can be done.

As long as you have not been sentenced yet you can move to retract your guilty plea. The judge does not have to approve your motion, but there is a strong possibility that he will allow you to do retract your ple. Usually the result of retracting your guilty plea is setting the case down for a trial. I am an attorney who practices criminal defense law throughout the state of New Jersey.
