Legal Question in Criminal Law in New Jersey
I plead guilty to the following 1 count of :
2C:15-1A1*2 Robbery-Bodily Injury or Force /2 in 2003. It was a first degree charge, but I was sentenced under second degree guidelines to 6 yrs with 85% N.E.R.A. with 5 years parole. My question is that since second degree guidelines were used in sentencing, shouldn't the parole term also be second degree, which would be 3 years? I have served all prison time and 3 years of parole now. I would be interested in retaining a lawyer that can help to eliminate remaining parole. Please advise.

It sounds like you may want to petition the court for a change of sentence. You will need an attorney experience in PCR (post conviction relief). If you are currently incarcerated, have a friend or family contact me to discuss your case.
