Legal Question in Criminal Law in New Jersey
Can the police confiscate my car?
My ex-boyfriend lent his friends (who I don't know) my car and they were involved in a fight with another group. Someone from the group ended up in the hospital with a broken elbow. The cops went to my house looking for me. I went to the precint and told them I didnt know about the fight or that my car was used by these people that I don't know. I gave them a signed statement and my conversation was recorded. They did the same with my ex-boyfriend. I helped them in any way possible but now they went to my house again and are saying if I don't go to the precint and watch a video of the fight to identify the driver they will confiscate my car. Can they do this? And if they do, what do I do to get my car back? I don't know this guy that was driving my car so why do I need to be the one being harrassed by the cops? They know where my ex lives, why can't they go look for him to be the one to watch the video?

In some circumstances a car be forfeited if used in a crime. You should probably see a lawyer to suggest to the police that they seek to ID your ex's friends as you suggest. If you do NOT know the friends, is that a problem to see the video and tell them that you don't?
As my Law Guru colleague suggests, legal help is cheaper before charges are filed and/or you get them thinking you are hiding something. Good luck.
Re: Can the police confiscate my car?
This sounds like it is getting bad fast. I suggest you get an attorney ASAP! They can take your car whether you help or not, so I suggest you have someone help you with this. Right now you are not charged with anything, so it will not be expensive to get representation.
I'll be around during the weekend, so feel free to call me at 732/247/3340. You'll get my voicemail, just leave a message and I'll call you right back.
