Legal Question in Criminal Law in New Jersey

If an arresting police officer is making homosexual remarks to the defendant(s), and using extremely foul language, is this grounds for dismissal on a case. Also, if an officer asks to look in a closed school bag and finds tools he believes were used in a crime, then searches the car and finds the defendants in possession of stolen property, is that considered an illegal search and seizure? Considering that the bag had a legitimate expectation of privacy.

It sounds like an unconstitutional search and seizure.
