Legal Question in Criminal Law in New Jersey

police report not totally accurate

I was arrested and charged with possession...my record is long. The police report states that I approached an individual under watch and money appeared to be passed. It states I was alone. I did have drugs on me but not from the individual they say I bought them from...no money was found on either of us and a friend that was with me was not searched and he was let go right away. There is no mention of the guy I was with in the police reports. He is currently in a drug rehab program in NY but I don't know which one. How can this be brought into court and is it an option if I can't find the guy? Why would the police not mention the other person with me? If part of the report is inaccurate can the entire thing be thrown out?

Re: police report not totally accurate

To the extent that you can produce evidence which contradicts what the officer testifies to you can improve your defense.

You might investigate whether there were any surveillance video cameras on

any of the nearby buildings on the date in question. If they were the videos must be obtained immediatley before the tapes are reused and the video of your incident erased.

Call me if you like.
