posession of marijuana

im being charged with a violation of njsa 2c: 35- 10A (4). i have no criminal history and id like to know how i can ask for a conditional discharge.

A lot depends on which Judge and which prosecutor you are dealing with. It may be wise to at least consult a local attorney. I practice in Southern Nj and can give you an accurate read on things here.

In a polite manner. Some judges view CD's as mandatory for 1st offenders, many that I know don't. Thus, it may pay off to have an attorney. In addition, you may have other charges and tickets that you may still have to pay for. Can't hurt to pick up the phone and speak to an attorney before you do anything.

In addition, once you use your CD, you can never get PTI. Thus, you may not want to burn your CD right now if you can easily win your case.
