Legal Question in Criminal Law in New Jersey
Possesion of fireworks/Disorderly conduct
My son (16 yr) was arrested for possesion fireworks/disorderly conduct.He didn't have actully have any on him at the time of arrest but the police say there is a witness and possibly the police saw him light off a bottle rocket.This is a first time offense. We don't know the actual charges yet but they mentioned the above.
Question: Should I get a lawyer (is this serious?)
Question: What are the possible penalties ?

Your son should have an attorney. Fireworks are essentially explosives. Were there any fireworks connected injuries at about the time that you son was charge?

This isn't the most serious charges in the world. But it sounds like he has a good case and there is no point in him having a criminal record if he didn't do anything. When your teenage son is facing criminal charges I would certainly recommend that you get him a lawyer, especially when there is a question about whether the police can even prove the case against him. The police and prosecutor have the job of trying to convict your son. A defense lawyer has the job of trying to defend your son in any way possible within the confines of the law. The potential penalties your son is facing are heavy fines, a juvenile record, and possibly even time in juvenile detention.
