Legal Question in Criminal Law in New Jersey

Possesion of Marijuana

I have three friends who were smoking down the shore. One of the friends named ''R'' had a bag with about 1 gram and when he saw the officers coming gave it to a girl named ''G'' who threw it in the trash. The officers questioned everyone and eventually arrested ''g'' and the third person ''A'' because they said they saw ''A'' pass it to ''G'' and then ''G'' threw it out. They charged ''g'' with possession. What happens if in court the truth comes out that ''S'' originally had the bag. Is there a chance they drop the charges against ''a'' and go after ''s'' even though in the police report it says they saw A pass it to G.

Re: Possesion of Marijuana

The ones who merely passed on the drug so that it could be disposed of could have their charge changed to a disorderly persons offense having to do with preventing the recovery of the drug. You can call me at 800 273 7933 and you can visit my website by clicking on www.garymooreattorneyatlaw.com.
