Legal Question in Criminal Law in New Jersey

possession alcoholic beverage underage

I was walking into a hotel with my friend and as we were making it to the front door a cop came from behind. He asked us our names and for identification. We handed them to him. Then he spoke into the radio and asked for the names of the people he was looking for and the kind of car. As it turns out neither the car or the names were mine nor my friend's. Then they asked us to put our hands in the air so they could search us. That is when they found the alcohol in my pocket. Is this an illegal search and seisure?

Search and Seizure is a complicated area of the law and I would need to hear more about the specifics of your case before giving an answer. It seems kind of odd that they just searched you and your friend out of the blue AFTER they determined that you were not who they were looking for - we would need to explore the facts of your case a bit. If you are facing a court date in South Jersey and would like a free consultation to determine whether or not you want to hire an attorney then please contact me at your convenience.

Thanks,
