Legal Question in Criminal Law in New Jersey

Possession Charge

3 People in a car. 1 had .5g of weed in his jacket. Other 2 had no idea of the person's possession. Police found only the .5 that was in the driver's jacket. Car was parked not moving/keys were out/not started. Car was full of smoke that smelt like marijuana. Nothing else was found. Car was searched. All 3 were charged with possession in a vehicle. Should charges be dropped for 2 kids that did not know of other kid's possession?

Constructive possession occurs when you should have known that someone else had contraband on them, in this case the smoke filled car could arguably have been seen to be sufficient notice for you to atleast have had an idea that it could be that there was some possession in the car...

There are varuous ways to potentially counter that argument, I would suggest hiring a good lawyer.

"Should" charges be dropped? Absolutely. Will they be dropped? Ah, there's the rub. The answer to that question depends on the municipal prosecutor. If the prosecutor refuses to drop the charges, then the other two really need lawyers skilled and experienced in that area.
