Possession of Marijuana out of state resident

My son and his girlfriend (both 21) were pulled over when a police officer observed them smoking marijuana in her car. My son was the passenger and his girlfriend was driving. He was charged with possessing less than 50 grams. She may have had additional charges as they searched her bag and found some marijuana there. Both are residents of New York. Would a ''Conditional Discharge'' be a possiblity for them? If not, what might they expect?

In New Jersey posession of under fifty grams of marijuana is a disorderly persons offense. Conviction can lead to heavy fines, jail time (up to 6 months) and loss of driving priveleges. A conditional discharge is not automatically granted and in fact there is more than one type of conditional discharge. Depending on the circumstances of the case, there may even be grounds for filing a motion to suppress the evidence in your son's case since he was a passenger. There are a lot of factors to consider in this case, and I certainly would not recommend that your son (or his girlfriend) go to court without a lawyer.
