Possession Of Stun Gun in New Jersey
As a student i bought a stun gun in Oklahoma for personal safetly based on a reccomendation of cop friend. Though I bought the ''taser'' on Ebay, i never even bothered to buy the 9V battery it runs on. I shoved the thing in my glove box and left it there permanently.Few years later i moved to New Jersey. I've been here for 3 years now. Last week I was pulled over by cops for not wearing seat belts. I opened my glove box for insurance papers abd they saw the stun gun and arrested me on the spot for possession of it. Now I am a legal resident who is working towards his green card. i have no backgroung whatsoever. infact I have zero points on my drivers license. my immigration lawyer has suggested me to get it dismissed somehow. what are my options??

You can apply for first offender treatment. The problem is that the prosecutor has to consent to same. You need to hire an attorney to assist
you with this problem.

You have plenty of options.
1. YOu may challenge the validity of the stop - however if you were truly not wearing a seatbelt, and the gun was in plain view, you have little chance of success.
2. Depending on the charge, and your ability to demonstrate that the "weapon" was inoperable, you have a complete defense.
3. You may be able to negotiate a downgrade to a disorderly persons offense, which wouldn't constitute a conviction for a crime.
4. You could apply for pre-trial intervention, a form of probation like supervision which will result in the eventual dismissal fo the charges.
Which course is the right one to follow is a choice you should make with a good criminal attorney after he has had an opportunity to review the state's version, conduct an independant investigation if necessary, and negotiate with the Prosecutor on your behalf.

Your only real option is to get a good attorney to fight this case and prevent you from being convicted of a felony. The success of the options that Mr. Grassi articulated will largely depend on the lawyer you get.
