Prearraignment Conference-Insurance Fraud-Criminal Attempt, Agg. Arson

My husband's car was stolen. Car recovered burned. Insurance Company denied claim saying car can't be stole because of transponder system. We filed suit agains insurance company and have since had to drop the case, our attorney was appointed judge and could no longer represent us. All the other attorneys wanted a $10,000 retainer to go up against the insurance company, we could not afford it so insurance attorney agreed to drop the case. Now we receive a letter saying he has to appear for a prearraingment conference for charges of Agg. Arson, Insurance Fraud and Criminal Attempt. We are innocent of all charges and the only reason why we dropped it is because we didn't have money. Can public defender help?

These are very serious charges. You need an attorney. If you can not afford an attorney you must obtain the services of a public defender. I would think that, given the serious nature of the charges, you shouls hire an attorney, if there is any way that you can.

Apparently, you have been indicted. I would doubt that the criminal charge has anything to do with your dropping your civil case.

If you're scheduled for a pre-arraignment conference, you have been already indicted. If you are not represented by an attorney, you may apply for public defender services which are available to financially qualified defendants; otherwise, you will have to retain an attorney.

It sounds like you would qualify for the public defender, which are outstanding and experienced attorneys. Equally important, they are un court every day, with the same Judges and Prosecutors. That can be a great advantage in resolving the case. Are you sure it is a pre-arraignment conference and not a pre-indictment conference?
