Legal Question in Criminal Law in New Jersey

probation violation

my boyfriend is on federal probation for a 25 gram marijuana charge until sept 25, 2003. he got arrested on sept 3 for a disorderly conduct and resisting arrest. his court date for this offense is sept.30, 2003. Is it a violation of his probation to have been arrested even though at the time he is released from probation he will have not yet went to court for the sept.3 offense and is still presumed innocent? If so what are the chances his probation officer will find out about this offense? He was told a criminal chack would have to be run before he could be released from probation. do pending charges appear on a criminal check?

It is probably a violation of probation to fail to report an arrest to the probation officer. It is better to tell the officer than to hide it and have the officer discover on his own
