Legal Question in Criminal Law in New Jersey
is the prosecutor allowed to mislead grand jury by telling them that a witness in fact indicated in her statement that she said something that she didn't say?

The prosecutor is not allowed to mislead a grand jury. You would only be able to know what occurred by reading the Grand Jury Minutes. However, getting an indictment dismissed for prosecutorial misconduct is extremely difficult to do. How would you know what occurred in the Grand Jury proceedings (they are Private), unless you were part of it. The standard to attack a Grand Jury Indictment is difficult and the prosecutor has a wide range of discretion. Feel free to call with any other questions (201)-894-9498
No they are not allowed to give false information to the grand jury. Please contact me to discuss your case in more detail. I never charge for simply talking to a person about their case. Thank you.
