Legal Question in Criminal Law in New Jersey
purpose of pre-indictment conference
What is the purpose of a pre-indictment conference? I was under the impression that it was to find a way to lessen or dismiss the charges.

Re: purpose of pre-indictment conference
I find that they are sometimes the best way to close the case quickly with the best resolution. If you have an attorney that is creative, it can end the matter and get the best results.
I am always available for a free phone consultation.
Re: purpose of pre-indictment conference
Yeah, PIP conferences as they are called are to try to resolve the case (almost always by way of plea or PTI) before indictment. However, not every case gets resolved because they are just too serious or the AP just wants to indict. In some situations, we have been able to get the cases dismissed at this point.
Hopefully you have a good attorney, but I'm guessing you don't since he or she could have answered this question for you.
My initial consultations are always free, so call me at 732/247/3340 and we can discuss your case in more detail.
Re: purpose of pre-indictment conference
A preindictment conference can have a number of outcomes. The matter can be returned to municipal court as an amended, lesser charge. A plea bargain can be entered into. First offender treatment, known as Pretrial Intervention, can be granted so that after a period of supervision by the probation department the charge is dismissed. Nothing can happen so that the charge is referred to the grand jury for a formal charge known as an indictment.
