right to put hands on throat?

A store employee put his hands around my sons throat to stop him from leaving. He was going to shoplift but changed his mind, dropped stuff in side store and tried to leave. he successfully left but hours later was charged with strong arm robbery, (he had shoved the man off of him).

Your son needs to contact a lawyer asap. Force used in an attempted theft (shoplifting) amounts to robbery. Strong arm robbery is a 2nd degree crime. If convicted, your son is facing between 5 to ten years in prison. Robbery is a NERA (no early release act)offense which means that 85% of the sentence must be served prior to parole eligibilty.

Your son may have a defense, and a review of the facts may show that he was improperly charged. Your best course of action is to consult with an experienced criminal attorney.
