Legal Question in Criminal Law in New Jersey
The question of theft
My nephew recently committed theft of merchandise worth $450 from a department store. He did not get caught, but I believe that they have him committing the crime on survailence camera. Also, I believe that one of the store workers may have gotten his license plate number which is registered to my house. I am unsure what to do. If I report it then he will obviously have legal issues to deal with.
Can / will they come looking for him for a matter like this?
Can / will they get a search or arrest warrant?
Can / will they prosecute based on the survailence camera?
Is this a felony?

4) No, NJ does not rank this as a felony but as a 4th degree theft (between $200-$500). An aggressive law authority person could also charge you with receipt of stolen property.
See a lawyer for yourself and for him. Separate counsel might be needed. But act before police contact or an arrest and you can minimize damage to yourselves.

This is a fourth degree felony because the amount of the theft is over $200.00 but less than $500.00, and by definition it will be heard in the Superior Court (County Court) instead of the local Municipal Court. The potential maximum penalties include up to 18 months in state prison and $10,000.00 in fines. If they can trace your nephew back to your house they can get an arrest warrant and a search warrant. The surveillance camera will be used as evidence against your nephew. If the police bring a charge against him then I would strongly recommend that he hire a lawyer.
