Legal Question in Criminal Law in New Jersey
Recently I worked for a restaurant. I had problems and left the place of employment. I threw away all my belongings to the job that night, and left. A month later i received a summons in the mail, that there was a change in the court date, for this charge, even though,I was never arrested, processed, or given a FIRST court date. The charge is unlawful theft by taking. I would like to know how this is even possible, considering the fact that i haven't been arrested, nor is there a warrant out there, just a court date to come to court....I need to find out what the charge actually carries with it, considering there is NO CHARGE on the complaint paper just a complaint number...
Thank you in advance

Screw ups do happen, even in the court system. Apparently, there is a charge against you that was written up as a summons, requiring you appearance in court, as opposed to being issued in a warrant, requiring your being arrested by the police. At the first appearance you will probably be arraigned, meaning you will be advised of the charge against you.
If I were your attorney, I would simply request the discovery for your case, which would include the police reports and a copy of the complaint setting forth the charge against you.
You should give me a call. Call me if you like.

I would have to see all the paperwork on this case, including the summons you received before I could give you an answer. It's possible that it is a citizen's complaint against you and not a complaint issued by the police. Anyway, you now have a theft charge against you for not returning your uniform that must be addressed. If you are found guilty of this charge you would have a criminal record. Please contact me for a free consultation. Thank you.
