Legal Question in Criminal Law in New Jersey
I was recorded by an undercover officer saying some things that got me into trouble with the law. The officer used a digital recording device to record the conversation and my attorney has now received a copy of the tape in the discovery.
After listening to the tape, I strongly believe that it has been altered, because there are things I remember saying on there which are not on the tape. Can I do my own investigative work and hire a forensics analyst on my own and give him the tape or must I go through my attorney and have him send the tape.
Also, if it was in fact altered, can the charges be dismissed?

Everything should go through your attorney.
You need the guidance of an attorney in having the recording analyzed by an expert, which is
your right. Obtaining a copy of the original recording for the analysis will require your attorney to
demand same and file a motion to compel same if the state refuses to cooperate.
