Refund Fraud

I was wondering the statute of limitation of refund fraud? Also, if the person gives back the money before police are called, is it possible charges will be brought up in the future?

It depends on what we are talking about here, but in general, 5 years. If you steal a car and give it back, you still stole a car, so yes, a crime is a crime regardless of when you change your mind. Might be time to pick up the phone and consult with an attorney.

Obtaining or gaining something by means of false pretenses is theft and if the amount of money or val involved exceeds $200.00 the theft is a crime. The statute of limitations for the crime of theft is five years. The statute of limitations for theft under $200.00 is one year.

If you give back the money you could be prosecuted but it is more likely than not that you will not be prosecuted if you return the money BEFORE a charge is filed against you.
