Legal Question in Criminal Law in New Jersey
is it possible to reopen a case you pleaded guilty to but you know your innocent? its a gun charge and theres no vidence and the cops who supposibly saw my boyfriend with a gun had different stories. he pleaded guilty because his lawyer said theres a big chance he wont win through a trial?

It is extremely difficult to take back a guilty plea. When a person pleads guilty to a criminal charge in New Jersey he signs a multiple page very detailed plea form which explicitely asks if they are pleading guilty because they really are guilty. In addition to this, they have to tell the judge on the record exactly what they did, and they have to tell the judge that nobody is forcing them to plead guilty. That having been said, the person does have the right to file an appeal within 45 days of being sentenced on their criminal charge, Please contact me if you would like to discuss this in more detail.
