Legal Question in Criminal Law in New Jersey

reopening a case.

How long do you have to appeal a court decision? I was looking over a colleagues case and found that he was put under distress in the court room and pleaded guilty to a sexual assault claim. No evidence was found, and the ''victim'' waited two years to file the complaint against the defendant. Other than a verbal statement there was no concrete evidence supporting this claim.

A criminal case can always be reopened where it appears that a guilty plea was coerced.

It is certainly possible to withdraw a guilty plea, where that plea was coerced.

In addition to what the other attorneys said, you have 45 days for a direct appeal and 5 years for another type of appeal.
