Legal Question in Criminal Law in New Jersey

Need to Resolve 13 year Suspended License

After getting caught for my 3rd offense while driving suspended, I moved away and have established a good life for me and my children. I desperately want to get my license reinstated in NJ without going to jail. I have already paid my surcharges in full but because of the 3rd offense, they require me to fly back in town to go to court and possibly go to jail. What can I do to avoid going to jail and just resolve this matter out of state? I don't plan on EVER driving in NJ again but I would at least like to legally drive where I live and possibly teach my children how to drive when they come of age. I've tried to contact the courts to settle this but they both informed me that I need to make an appearance. I forgot to mention earlier that I got busted driving suspended twice within a 2 week--name removed--period so I may possible have two 3rd offenses on my hand. Please help me!!

Re: Need to Resolve 13 year Suspended License

Since NJ law does list mandatory jail time for a third or greater driving while suspended conviction, the courts do require that you appear to settle these matters. However, just because the law says go to jail it doesn't necessarily mean that you will be going to jail. There are alternatives to jail if you are convicted. And besides that, the state first has to prove that you had legally sufficient knowledge of your suspension before they can convict you. I am an attorney who has handled many cases similar to yours in various courts in NJ in the past. Please contact me to discuss your case in more detail. I never charge for simply talking about a case with someone. Thank you.

Re: Need to Resolve 13 year Suspended License

A lot will depend on the court and if you entered a plea or not. The time is mandatory, so you don't have much wiggle room. You have a couple options and it may be a tough call on your part as to what you want to do. My consultations are always free, so call me at 732/247/3340 and we will discuss the situation.

Good luck!

If you are guilty of driving while suspended you are facing a certain jail sentence which can be served on week ends and possibly could be served at a jail where you live. You might give me a

call.
