Restitution Issue

Recently I received a tax doc back from NJ state advising they have used my refund towards a delinquent debt from NJ probation. 10 years ago I got a DP and was ordered to pay restitution (this was called a simple assault) and 5 yrs probation. I paid the restitution and even received notice from NJ state advising the debt was paid. Shortly after (about 1 year), I was released from probation and everything has been quiet in my life for nearly 8 years until this notice. I have no criminal record. The state never sent dunning notices to me and I received NJ tax refunds from previous years. Unfortunately I no longer have the docs to prove the restitution paid. I thought this was all in the past but they want to keep it alive, even though I paid my debt back to society. IS there a SOL on this and if not, what can I do? Thanks!

The conviction for the simple assault you got happened well within the computer age, so the probation department should have all the records of your case in their database. COntact them and they can give you a printout of the debt you owed and the amount you paid. THis is pronbably just an error that can be easily resolved. ONce you get the printout regarding the payoff of your debt you can contact the agency that sent you the withholding notice and get that fixed.
