Legal Question in Criminal Law in New Jersey
Road Rage
I was a victim of what I consider to be road rage this morning. I was driving when a car passed me on my left hand side, in a very dangerous manner. The light that was just ahead turn red and the gentlemen proceeded to wave his hands and curse in his rear view mirror. I flipped him the bird! Wrong! I know! Then he got out of his car and kicked my door, I got out and started to call the police just to have him attack me, hitting me jumping on me. Not once did I strike him, I had to get witnesses to call 911 because I was trying toget control of this guy. What are my legal rights in this matter? He was charge with a simple assault, but his reason was because I was driving slow and was making him late for work.. He needs to lose his license or something??

You might have a claim against him both for assault and for his driving. You should give our offices a call to discuss.

You did not mention any injuries to you. If there are any he would be required to pay you damages (including for the car repair).
