Legal Question in Criminal Law in New Jersey
Robbery and gun charges
This help is for my boyfirend who was arrested and charged with a robbery that he did not commit outside a local bar. He was standing with friends when the cops approached. He turned and walked into the bar because he was carrying an illegal gun. They came in after him and said that a man outside said he had robbed him. The victim was very intoxicated and did not file a report, he even left the scene when the cops him to do so. My boyfriend was assaulted by the cops and arrested anyway on a possesion of a weapon and robbery cgarges. With NO victim report. Witness outside the bar said my boyfriend had no contact with the ''victim'' at all. The bar also has a surveillance camera that could back this up. He has been incarcerated for 4 months now and bail has been set at 100,000 cash or bond. All of the sudden, robbery charges have disappeared of his charges and they are holding him for possesion charges and bugulary tools. (???) We can't quite understand that one. Can these charges stick witn no victim? If, so how much time is he looking at?

Re: Robbery and gun charges
Each case is fact specific, so I can't give you a definite answer until I review the facts of this case as listed in the police reports. In general though, based on what you wrote, the re is a possibility that the charges could be made to stick. Your boyfriend needs an attorney to help him out. I am an attorney who has handled many cases similar to this in various courts throughout New Jersey in the past. Please contact me to discuss this case in more detail. I never charge for simply talking to a person about their case. Thank you.
