Scratch off Lottery Ticket Theft

What are the consequences of someone who was arrested and charged with theft for stealing scratch off lottery tickets from a convenience store they worked at. Is the crime less if the tickets were all losers and weren't cashed in as winners? If you could advise on both aspects, I'd appreciate it. Thanks.

The consequences will depend upon several factors, including the precise crimes she is accused of committing and the total value of the stolen tickets. The value of each ticket is the price it would have sold for; whether it turned out to be a winner or a loser should be irrelevant.

If the person lawfully on the premises it would be a disorderly person offense so long as the tickets sold for less than $200.00

If the theft was accomplished subsequent to an unlawful entry into the premises that entry would be a burglary and a third degree crime.

The winning value of the tickets shouldn't matter, its how much they were sold for. It should be a disorderly persons offense as Mr. Moore indicated.
