Legal Question in Criminal Law in New Jersey

Search Warrant

If I was living out of the country and the police had a search warrant for my house in the USA, because of my son. Can they enter my bedroom even though I was not part of the investigation? If so what are the only reasons they would be allowed?

Re: Search Warrant

The police are required to execute the warrant within the paremeters of the authority conferred by the search warrant. If the search warrant is limited to one room, the police have that authority, although anything that is in plain view as they move within the house to that room would also be subject to seizure. I would suggest that you call me so that the question can be discussed with more information.

Re: Search Warrant

Your question, as worded, is too vague for a proper answer to be given. I would need a lot more information before I coudl answer it. In general though, if the police are able to obtain a search warrant for a house then they are allowed to search the whole house. I am an attorney who has handled many cases similar to yours in various courts throughout New Jersey in the past. Please contact me to discuss your case in more detail. I never charge for simply talking to a person about their case. Thank you.
