Legal Question in Criminal Law in New Jersey

Seduced, and now Accused

In september 2005 when I was 19, I was seduced when drunk by an older woman, 36, who had given me beer. When I digitally penetrated her, she started freaking out and ran out of the bed to get her husband. She was drinking also, and said she thought I was her husband.who was asleep in a separate bedroom. I am charged the next day with sexual assault by the state police. I have my arraignment April 30, and i want to plead not guilty. what are the chances this will put me in prison?

Re: Seduced, and now Accused

You are at least potentially looking at prison time if you are convicted of this. The whole scenario sounds fairly unusual to me - in fact I might even argue on the facts you present that no crime was committed at all. However, until I review all the evidence I cannot say this for sure. Please contact me to disuss your case in more detail. I never charge or simply talking to a person about their case. Thank you.

Re: Seduced, and now Accused

Your arraignment is on April 30? That seems unusual if the crime was in September 2005. You should definitely retain counsel for this, as it will likely result in jail time, and/or an inordinately high bail. I never charge just for a consultation. Feel free to call our offices.

You have a very serious legal problem that can only be resolved by a trial. You need a good attorney and a vigorous, effective defense.

You could go to prison and you could be acquitted. You must concentrate on preparing to defend yourself.

Call me if you like.
