Legal Question in Criminal Law in New Jersey
Sentencing
My husband was sentenced to 13.5 years; stipulated parol 3.5 years (burglary/theft). charged with 16, 3rd degree and 2, 4th degree. Sentenced to three consecutive terms of 4.5 yrs. The final charges same as original charges including degrees. Is this sentence excessive; are these non-violent charges; what are the chances for an appeal?

Re: Sentencing
The appellate division has an excessive sentencing panel that hears these types of appeals. If you feel a sentence is excessive, it is worth the trouble of appealing because to sit on your rights would get you nowhere.
However, chances of success depend on whether your husband had a prior record and the facts of the cases. Call me for a consultation 201-646-9799
