sentencing

Hi, I was just sentenced to 12 mths due to my pleading to 1 count of embezzlement. I have a husband and 2 children, it will be impossible for me to go for 12mths, we have noone to take care of the kids, Is there anyway i can get out of this or get weekend prison time./ My kids have to go to school please respond asasp i do not have much time.

When you are sentenced the judge can allow you to apply for house arrest whereby you would wear an electronic bracelet, like Martha Stewart, and be allowed to leave the house only for specific allowed purposes. The application is made to the County Sheriff. I would expect that a reasonable

amount of time would be allowed to transport children to and from school and doctors and possibly to work.

If you were going to get probation, the State would have offered it to you already. I doubt they are going to consent to house arrest, which will be along the lines of a probation. I'm just not sure its an option that a Judge will consider, but I need to know more info about your case.

Depending on the situation, you may be better off arguing for probation. We have a good record of undercutting the State's offer through a motion to the Judge.

Another option is to take back your guilty plea. While easier said that done, its not impossible and depending on the circumstances, it may actually be fairly easy to accomplish.
