Legal Question in Criminal Law in New Jersey
shoplifting
i am 25, live in the state of nj and was arrested for shoplifting $18 worth of merchandise from a store. i have a court date but am wondering in the mean time what the typical penalty would be for this sort of crime. will i most likely just get fined or have to do community service as well? also, i won't have to serve jail time, will i??

Shoplifting is theft. If you plead guilty or are found guilty you will find that many employers will not hire you. There are solutions. Give me a call.

The offense of shoplifting $18 dollars worth of goods is a disorderly person's offense and carries various sentences depending on whether it is your first, second or third offense. Assuming this is your first offense, it would be very unlikely for you to receive a term of imprisonment. Please contact this office if you would like to discuss the matter further.

Shoplifting is a violation of the New Jersey Criminal Code. Since you are dealing with a relatively small amount of value for the item allegedly stolen, it will be listed as a disorderly person's offense. The maximum penalties on a disorderly persons offense are a $1,000.00 fine and 6 months in jail. If you have no prior criminal record, you probably won't be facing jail time. However, please understand that you still face the POSSIBILITY of jail on this case, so don't let anyone tell you that you can't go to jail. Also, depending on the evidence in the case, there may be a way to actually beat the charge so you won't have any record at all. If not, I may still be able to get it downgraded to something other than an actual criminal code violation.
