Shoplifting
A 37 year female mother of 4, ages 1 month old to an 18 year ol college student. Caught shoplifting $150.00 worth of from Kmart in New Jersey. Has never been arrested ever. Admitted and signed form by the store that admits guilt. Had 14 month old with me. Afraid of being arrested , that was the reason for the confession. I thought I would be able to pay and leave. The story is I was looking for a gift with my 14 month old. I had two phones, one worth $109.00 the other $39.00. I went in bathroom to change my child, took the $39.00 phone with me because my son was playing with the bright orange box that it came in and because I was stressed with his whining, I let him continue to play with the box and open it as I was using the bathroom. He opened the box and hid the parts of the phone in the baby changing bag that I had. I did not know this. I left out the bathroom and left the box there. I picked up a gift bag for the phone I was to get and put the phone in the gift bag to see if it fit. At the checkout, I got distracted with the baby, I did not put the gift bag and phone on the counter with my other stuff. Because I was in a hurry, I did not pay attention to total Left store and alarm went off. Asked to come back and I did

Normally a confession is very difficult to overcome. However, in your situation it sounds as if there is a good basis for winning your case at trial, despite the confession. When you first go to court on this matter you must plead "Not Guilty" and ask the judge for time to hire a lawyer. If you plead guilty, then you will have a criminal record in addition to having to pay fines and other penalties. You can plead not guilty; have a trial and be found not guilty. Do not plead guilty because, although the fine will be relatively small and as a first offender you will probably not go to jail, shoplifting is theft and a conviction for same will make it impossible for you to obtain worthwhile employment.
