Legal Question in Criminal Law in New Jersey

Simple Assault

My brother has received a summons to go to court for a simple assault charge. He was never arrested. There was a fight between him and an old friend at a bar and the old friend filed a police report and now he has to go to court. What can he be facing, how serious is this? annd can he have these charges dismissed?

He is facing heavy fines and possible jail time of up to 6 months.The charge can only be dismissed if the prosecutor agrees to do so. The victim usually has to agree to a dismissal. They could be very serious. What's worse is that the guilty plea on the assault charge would pave the way for a civil suit. Have your friend give our offices a call.

Simple assault is a disorderly offense and as such has a possible, maximum sentence and find of six months and $1,000 respectively. It can be dismissed by the request of the complainant or by the court following a trial and a finding that the offense charged has not been proven by the State beyond a reasonable doubt. This is a disorderly persons offense carrying a possibility of 6 months jail and $1000.00 fine. If your brother is convicted of this offense and he has no prior convictions, a jail sentence is unlikely. If the complaining witness does not wish to prosecute and the prosecutor has no other independent witnesses or evidence, the court may dismiss the charges. Your brother should contact a lawyer for a consultation.

As the other attorneys said, he could be facing fines, probation, a criminal record and jail. I suggest he get an attoreny ASAP.
