Legal Question in Criminal Law in New Jersey
Simple Assault Charge
Recently I was charged with simple assault for an incident that occurred between me and a bartender of an establishment. After words were exchanged I slapped the bartender in the face. The police complaint report reads: ''within the jurisdiction of this court did commit an act of simple assault, specifically by slapping the victim in the facial area with an open hand, in violation of N.J.S.A. 2C:12-1a(1), a disorderly persons offense''. My plan was to plead guilty because I know I was in the wrong and sorry for what I did. My question is should I expect just a fine for this offense?
Thanks so much for you time!

Re: Simple Assault Charge
First, I don't suggest you plea guilty. I suggest you get an attorney first.
I don't your know criminal record, but assuming you have none, you probably won't go to jail although you may have probation. A lot depends on the prosecutor.
Keep in mind that by entering that plea, you will now have a criminal record and that will follow you around for quite some time. I see no reason not to get an attorney.
My initial consultations are always free, so call me at 732/247/3340 to discuss your case.
Re: Simple Assault Charge
The maximum potential penalties are fines in excess of $1,000.00 and up to 6 months in jail. Whether or not you will get any jail time depends upon the facts of the case and how the victim describes the incident to the police and prosecutor. I do a lot of criminal defense work. Please contact me if you would like to discuss how I can help you. Thank you.
