Legal Question in Criminal Law in New Jersey

Simple assault

I was charged with simple assault against my husband(he accused me with grabbing him on the neck and scratching him). He wants to dismiss charges now. The municipal court clerk told me that we still need to come to court. Could you explain me the process and up to whom is to make that decision. And how can I clear up my criminal record?

In court the person filing the complaint must indicate that he or she wishes that the charge be dismissed. If this is a domestic violence matter the officer must indicate this, at least to the prosecutor. Sometimes the judge will require that there be a cooling off period to confirm that the subject occurrence will not happen aqain and adjourn the case for six months before dismissal.

After the dismissal a petition to expunge the arrest record must be made to the Superior Court of New Jersey.

You may need a lawyer here. I would be real careful. I handle a lot of DV's and it has become very difficult for a person to drop charges. The State has been threatening to press charges against the victim if she (or he) tries to change her story.
