simple assault defense
I have a court date today (10-04-06) at 5:00 PM EST for a simple assault charge. I want to know how I can prevent getting a criminal record for this. The victim is not attending the court. details are as follows: domestic violence incident (I made the 911 call) in which I accidently hit the victim in the face while trying to escape her assault. I admitted to the officer arriving on the scene that I hit her and was arrested.
any help appreciated, don't care about fines - just trying to prevent a criminal record (no previous arrests - only traffic infractions)

The case will not be dismissed if the alleged victim is absent because there will some concern that you have done away with her. She must come to court to consent to the dismissal of the case.
Since the dismissal of the case is so important to you you should hire an attorney to insure this result.

On such short notice the only advice I can give you is to ask for an adjournment tonight so you can consult with a lawyer. Getting a dismissal of a domestic violence assault charge where you admitted your guilt to the police is not an easy task, and I would strongly sugest you get a lawyer to handle this properly. As the other attorneys said, DV cases are treated very seriously. Hopefully you can get it dismissed by yourself today but I don't see that happening.
